THE MEDALS OF FRENCH INDOCHINA

Le Gouverneur général de l'Indochine,

Vu les décrets du 20 octobre 1911, portant fixation des pouvoirs du Gouverneur général et organisation financière et administrative de l'Indochine;
Vu l'arrêté du 10 décembre 1916, portant organisation du personnel de l'Administration Pénitentiaire de l'Indochine,

      ARRÊTE :

Article premier. — Le 1er paragraphe de l'article II de l'arrêté du 10 décembre 1916 est complété comme suit :

Les emplois de Greffiers sont réservés aux Commis-greffiers, aux Gardiens-chefs et Gardiens ayant subi avec succès l'examen prévu pour les Commis-greffiers et ayant rempli ces fonctions pendant six mois au moins.

Art. 2.  —  L'article 29 de l'arrêté du 10 décembre 1916 est abrogé et remplacé par les dispositions suivantes :
Les agents français seront classés dans le cadre de la nouvelle formation à une classe correspondant à leur grade actuel et de façon que chaque agent bénéficie de l'augmentation de solde que comporte la nouvelle hiérarchie. Ils conserveront, après leur classement, l'ancienneté acquise dans leur ancien grade.
Les agents indigènes seront classés dans le cadre de la nouvelle formation à une classe comportant un traitement équivalent à celui dont ils jouissent ; ils conserveront, dans ce cas, l'ancienneté acquise dans leur ancien grade.
A défaut  d'équivalence de solde, ces agents indigènes auront droit à la classe comportant la solde immédiatement supérieure, mais prendront rang dès lors, dans leur nouvel emploi, en ce qui concerne l'ancienneté, pour compter de la date de leur classement.
Des arrêtés spéciaux pris sur la proposition du Gouverneur de la Cochinchine et des Résidents supérieurs détermineront le classement dans les nouveaux grades du personnel actuellement en service.

Art. 3. — Les agents ayant été l'objet d'une promotion depuis la publication de l'arrêté du 10 décembre 1916 seront classés au grade immédiatement supérieur à celui qu'ils avaient avant la publication dudit arrêté. Leur ancienneté datera de leur dernière promotion.

Art. 4. — Une médaille d'honneur en argent du modèle de celle qui est attribuée au personnel de l’Administration Pénitentiaire coloniale, mais avec devise spéciale à l'Indo-Chine, est instituée en faveur du Service Pénitentiaire de l'Indochine.
L'attribution de cette médaille donne droit à une allocation annuelle de 100 fr. (cent francs), qui est payée leur vie durant aux  titulaires.
Cette allocation sera payée par le Budget du pays où le titulaire se trouvera en service.

Art. 5. — Le Gouverneur de la Cochinchine, les Résidents supérieurs au Tonkin, en Annam, au Cambodge et au Laos sont chargés, chacun en ce qui le concerne, de l'exécution du présent arrêté.

The Governer General of Indochina,

In view of the decrees of October 20th, 1911, fixing the powers of the Governor General and financial and administrative organization of Indochina;
In view of the decree of December 10, 1916, concerning the organization of the staff of the Prison Administration of Indochina,

      ORDERS :

First article. — The 1st paragraph of article II of the order of December 10th, 1916 is supplemented as follows:

The employment of clerks is reserved for assistant registrars, chief guards and guards having successfully passed the examination for assistant registrars and having fulfilled these functions for at least six months

Article 2. — Article 29 of the decree of December 10, 1916 is hereby repealed and replaced by the following provisions:
French agents will be classified in the cadre of a new formation to a class corresponding to their current grade and such that each agent receives a pay increase that includes the new hierarchy. They will retain, after their classification, the seniority acquired in their former grade.
Native agents will be classified in the new cadre of the new formation to a class with an equivalent treatment to that which they enjoy ; they will retain, in this case, the seniority acquired in their former grade.
In the absence of equivalence of balance, these native agents will be entitled to the class with the balance immediately above, but will take rank of when, in their new jobs, with regard to seniority, to count from the date of their classification.
Special orders taken on the proposal of the Governor of Cochinchina and Residents Superiors will determine the classification in the new grades of staff currently in service.

Article 3. — The agents having been the object of a promotion since the publication of the order of December 10th, 1916 will be classified in rank immediately the upper in the one that they had before the publication of aforementioned order. Their seniority will date from their last promotion.

Article 4. — A medal of honor in silver the model which is attributed to the colonial Prison Administration staff, but for use specially in Indochina, is established for the Prison Service of Indochina.
The award of this Medal is entitled to an annual allowance of 100 fr (100 francs), which is paid for the holders life.
This allowance will be paid by the Budget of the country where the holder will be in service.

Article 5. — The Governer of Cochinchina, the Residents Superious of Tonkin, Annam, Cambodia, and Laos are responsible, in so far as each is concerned, the execution of this order.
